STEVENS POINT, WI (WSAU) — A Portage County man has been found guilty of operating while on a controlled substance as part of a plea deal.
Eugene Volk entered a no contest plea to the count on Thursday morning, in exchange two additional OWI-related charges were dismissed outright. Two charges for resisting an officer and operating with a revoked substance were dismissed but read into the record, meaning they can be considered at sentencing.
The 67-year-old was stopped on January 18th when officers observed him driving outside of his allowed hours. He initially refused to pull over, but officers caught up to him in a residential driveway. He initially told them there was no probable cause to stop him.
Volk later admitted to having one drink before driving. A search of his car turned up three beer cans.
His previous OWI convictions date back to 1990 and include three charges in Arizona and nine in Wisconsin. His last conviction came in 2018. Prosecutors are asking for a sentence of nine years in prison and five years on extended supervision.
Court records show Volk is being held at a correctional institution outside Baltimore, Maryland. He’s due for sentencing on October 30th.
