MERRILL, WI (WSAU) — The 17-year-old charged as an accomplice in the death of Lincoln Hills Correctional Officer Cory Proulx will continue to face charges related to his death.
Rian Nyblom is facing a count of felony murder with special circumstances and battery by prisoners. Investigators say he gave Javarius Hurd a cup of soap which he threw in the face of another correctional officer before beating her.
Hurd walked away from the initial confrontation but was chased outside by Proulx. The 16-year-old then attacked him, causing him to fall and hit his head. Proulx was rushed to a local hospital where he was declared brain dead.
Nyblom’s defense team has requested the dismissal of the felony murder charges. A judge denied that motion on Monday and scheduled a preliminary hearing for September 17th.
The defense has also requested a change of venue for the case. It’s unclear when that will be considered.
Hurd is facing a count of reckless homicide, he’s scheduled to return to court on September 17th for a status conference.
