Saavedra asks for new judge in fatal DUI case


STEVENS POINT, Wis. (WSAU) - The man accused of killing two passengers in a drunk driving crash in Rudolph is asking for a new judge and a bond modification.

Attorneys for 22-year-old Timothy Saavedra are asking for Judge Thomas Eagon to recuse himself from the case, and for a bond modification to allow Saavedra to talk to the remaining victim from the crash.

Police say he was behind the wheel June 20th when his truck went off the road, killing 21-year-old Melissa Peterson-Suzda and 21-year-old Stephanie Eberhardt. The other victim in the truck, 21-year-old Lee Hogan was airlifted to a hospital and survived the crash.

Data recovered from the truck shows it was going 94 miles an hour before the crash and police say he blew a 0.14 BAC after the crash.

Saavedra will not enter a plea to the charges until the request for recusal can be heard. That hearing is set for October 11.
