WAUSAU, Wis. (WSAU) -- Marathon County prosecutors have dropped perjury charges against a former Athens basketball coach convicted of using a computer to facilitate a sex crime with a former student.
56-year-old Rory McKellips and his 57-year-old wife Constance were scheduled for a jury trial for lying at the sexting trial, but a judge threw out evidence in the case.
Prosecutors stated in court that they could no longer move forward with the perjury cases, and dismissed them. The case against Constance McKellips is now off the books. Judge Mike Moran will be able to consider the perjury charges against Rory McKellips at an upcoming sentencing in the sexting case.
McKellips will be back in court December 6th for that sentencing hearing.
