EAA files court petition seeking over $447K for air traffic controller fees


OSHKOSH, WI (WTAQ) - The Experimental Aircraft Association says it has filed a petition with the U.S. Court of Appeals in Chicago over the Federal Aviation Administration’s fee for providing air traffic controllers for AirVenture 2013. 

EAA is asking the court to review and provide relief from payments to the tune of $447,000. 

EAA agreed to pay the fees, but has only paid half of them so far. 

The FAA was given the power by Congress in April to better handle sequestration cuts, and this was one of the directions it took. 

AirVenture has never been charged by the FAA to provide air traffic controllers. 

In its petition, EAA says “the fees were imposed without standard notice and comment procedure from the FAA, making it procedurally improper and unlawful.”  

The EAA’s appeal could affect other aviation events around the nation who were also assessed fees in the same manner.
