Mayer to get new trial in April


WAUSAU, WI (WSAU) -  The Marshfield area man who was convicted of killing his girlfriend with a single blow to the head in 2009 will get a new trial this spring. 32-year-old Eric Mayer returns to a Marathon County jury April 22nd. The trial is expected to last three days.

The complaint says his girlfriend Cynthia Tyler kicked him in the mouth, and then he struck her in the face while traveling home. Tyler was unconscious. It also says that Mayer called 9-1-1 when Tyler wouldn’t wake up.

Marathon County Judge Mike Moran vacated Eric Mayer's conviction on felony murder in October of 2011. The court ruled Mayer had ineffective counsel after he was given incorrect information about the four elements of misdemeanor battery crime that makes up the felony murder statute. His former attorney also improperly explained the penalties Mayer could face.

He has been free on a $50,000 cash bond since August.
