WAUSAU, WI (WSAU) -  A Marshfield man is getting a new trial after being convicted of causing his girlfriend’s death in 2009. 32-year-old Eric Mayer entered a plea deal three years ago and was sentenced to ten years in prison for the death of Cynthia Tyler.

Mayer told investigators Tyler kicked him in the mouth and then he hit her in the face. Tyler went unconscious and later died from a ruptured artery in her head.

Meyer filed an appeal claiming he had ineffective legal counsel. The Court of Appeals agreed and ordered a new trial, which starts August 20th before Judge Michael Moran.

That trial is expected to last four days.
