Ponce-Rocha loses appeal in murder conviction

WAUSAU, WI (WSAU) - The man convicted of killing Breanna Schneller appealed and lost. Raul Ponce-Rocha was convicted in 2011 for stabbing and bludgeoning Schneller in her Wausau apartment.

Judge Patrick Brady sentenced him to life in prison at that time, and Ponce-Rocha appealed the ruling claiming the DNA evidence should not have been admissible in court.

A three judge panel from the Wisconsin Court of Appeals first district denied Ponce-Rocha’s appeal March 28th. The appellate judges issued a sixteen page ruling affirming Marathon County Judge Patrick Brady’s decision. They ruled the DNA evidence was admissible in court and they ruled that Ponce-Rocha was not in custody during his initial questioning by officers.

Marathon County District Attorney Kenneth Heimerman prosecuted the case.

Breanna Schneller died in early May of 2009. She was a D.C. Everest student.
