Appeals court rules Ametek could be liable for defective equipment supplied to CNH


WAUKESHA, WI (WTAQ) - A state appeals court ruled Wednesday that an electronics-maker could be liable for defective equipment that was supplied to a manufacturer of farm tractors in Racine.

The Second District Appellate Court in Waukesha reversed a circuit court ruling from Racine County, which said that Ametek Incorporated did not have to pay damages to CNH.

The tractor company accused Ametek of providing defective starters for the CNH B-6 tractor line in 2006 and ’07. The faulty starters led to a worldwide recall of the tractors.

Ametek said CNH knew the starters were faulty, but kept using them anyway. A circuit judge in Racine County agreed, and said CNH was not entitled to damages.

But Wednesday, the appellate court reversed the ruling. It said a jury could find that Ametek caused all or none of the CNH recall costs, depending on how the jurors might interpret CNH’s actions.
